Avantgarde Properties GmbH ("Avantgarde", "we", "us") takes the protection of your personal data seriously. This Privacy Policy explains which personal data we collect when you visit avantgardeproperties.com or contact us, for what purposes, on which legal basis and what rights you have. We process personal data in accordance with the EU General Data Protection Regulation (GDPR), the Austrian Data Protection Act (DSG) and the Austrian Telecommunications Act 2021 (TKG 2021).

2. What data we process and why
2.1 Visiting our website
When you access our website, our server automatically records technical information that your browser transmits: IP address, date and time of access, pages visited, referring URL, browser type and version, operating system and language settings. This data is required to deliver the website, to ensure its stability and security and to detect misuse.
Legal basis: our legitimate interest in the secure and reliable operation of our website (Art. 6(1)(f) GDPR).
Retention: server log files are deleted after [30] days, unless a longer retention is required to investigate a specific security incident.
2.2 Contact forms, email and phone
When you contact us via a form, email or phone (for example to request information about a property, arrange a viewing, subscribe to updates or offer your property for sale or rent), we process the data you provide: name, contact details, your message, the property concerned and any other information you choose to share.
Legal basis: steps prior to entering into a contract or the performance of a contract (Art. 6(1)(b) GDPR); otherwise our legitimate interest in responding to your enquiry (Art. 6(1)(f) GDPR).
Retention: as long as necessary to handle your enquiry. If no business relationship follows, we delete the data after [3 years] at the latest, unless statutory retention obligations apply.
2.3 Real estate brokerage services
If you engage us as a real estate agent, as a buyer, seller, tenant or landlord, we process the data required to provide our services, for example identification data, contact details, information about the property, financial information relevant to the transaction and correspondence.
As a real estate agent we are subject to the anti-money-laundering provisions of the Austrian Trade Act (GewO). We are therefore legally obliged to verify the identity of our clients and, where applicable, of beneficial owners, and to retain the related documents.
Legal basis: performance of a contract (Art. 6(1)(b) GDPR) and compliance with legal obligations (Art. 6(1)(c) GDPR).
Retention: for the duration of the business relationship and thereafter for the periods required by law, in particular 7 years under Austrian tax law (§ 132 BAO) and the retention periods under the anti-money-laundering provisions of the GewO.
2.4 Newsletter ("Insights & Updates")
If you subscribe to our newsletter, we process your email address and, if provided, your name to send you news about properties, markets and our services. We use a double opt-in procedure: your subscription only becomes active after you confirm it via the link in our confirmation email.
Legal basis: your consent (Art. 6(1)(a) GDPR and § 174 TKG 2021).
Retention: until you unsubscribe. You can withdraw your consent at any time via the link included in every newsletter or by emailing us.
2.5 Cookies, analytics and marketing
We use technically necessary cookies and, only with your consent, analytics and marketing technologies (Google Tag Manager, Google Analytics 4 and Meta Pixel). Details, including the individual cookies and their lifespan, are set out in our Cookie Policy.
Legal basis: technically necessary cookies: § 165(3) TKG 2021 and Art. 6(1)(f) GDPR; all other technologies: your consent (§ 165(3) TKG 2021 and Art. 6(1)(a) GDPR).
2.6 Social media links
Our website contains simple links to our profiles on social networks and share buttons. These are plain links: no data is transmitted to the respective network until you click on them. Once you do, the privacy policy of that provider applies.
3. Recipients of your data
We only share personal data where this is necessary for the purposes described above, required by law or based on your consent. Recipients may include:
- IT and hosting service providers who process data on our behalf under a data processing agreement (Art. 28 GDPR), in particular our hosting provider [name and location of hosting provider];
- parties to a real estate transaction (for example sellers, buyers, landlords, tenants), notaries, lawyers, banks and property managers, where required to carry out the transaction;
- Christie's International Real Estate and its network partners, if you ask us to present your property internationally or request properties outside Austria;
- tax advisors and auditors, who are bound by professional secrecy;
- public authorities and courts, where we are legally obliged to disclose data;
- Google Ireland Ltd. and Meta Platforms Ireland Ltd., only if you have consented to analytics or marketing cookies.
4. Transfers to countries outside the EU/EEA
Some of the providers we use may process data in the United States or other third countries. Where this happens, we make sure an adequate level of protection exists, either through an adequacy decision of the European Commission (for the USA: the EU–US Data Privacy Framework, where the recipient is certified) or through the EU Standard Contractual Clauses (Art. 46(2)(c) GDPR).
5. Your rights
Under the GDPR you have the following rights regarding your personal data:
- Access to the data we hold about you (Art. 15 GDPR);
- Rectification of inaccurate data (Art. 16 GDPR);
- Erasure (Art. 17 GDPR), unless statutory retention obligations apply;
- Restriction of processing (Art. 18 GDPR);
- Data portability (Art. 20 GDPR);
- Objection to processing based on legitimate interests (Art. 21 GDPR), and at any time to processing for direct marketing purposes;
- Withdrawal of consent at any time with effect for the future (Art. 7(3) GDPR). This does not affect the lawfulness of processing carried out before the withdrawal.

6. Obligation to provide data
You are not obliged to provide personal data when visiting our website. However, certain data is required to answer your enquiry or to enter into and perform a brokerage agreement. Without this data we may not be able to provide our services.
7. Automated decision-making
We do not use automated decision-making, including profiling, within the meaning of Art. 22 GDPR.
8. Data security
We take appropriate technical and organisational measures to protect your data against loss, misuse and unauthorised access. Our website uses TLS encryption, which you can recognise by the "https://" prefix and the padlock symbol in your browser's address bar.
9. Changes to this Privacy Policy
We may update this Privacy Policy when our services or the legal requirements change. The current version is always available on this page.
