These Terms of Use govern your use of the website avantgardeproperties.com (the "Website"), operated by Avantgarde Properties GmbH, Seitzergasse 6, Golden Quarter / 5th floor, 1010 Vienna, Austria, VAT ID ATU66435226 ("Avantgarde", "we", "us"). By using the Website, you agree to these Terms of Use. If you do not agree, please do not use the Website.
1. Scope
These Terms of Use apply only to the use of the Website. They do not govern any real estate brokerage services. A brokerage relationship is established only by a separate agreement with us, which is subject to the Austrian Real Estate Agents Act (Maklergesetz), the Real Estate Agents Regulation (Immobilienmaklerverordnung) and, where applicable, the Austrian Consumer Protection Act (KSchG).
2. Property information
All property listings and information on the Website are provided for general information purposes and are non-binding. They do not constitute an offer, but an invitation to make an enquiry.
Property details, prices, floor areas, floor plans, images and other information are based on information provided by property owners or third parties. We prepare them with care but cannot guarantee that they are accurate, complete or up to date. Properties may be sold, rented or withdrawn from the market at any time. Images and visualisations may be illustrative and may differ from the actual condition of the property. Prior sale or rental and errors remain reserved.
Information on energy performance (HWB, fGEE) is provided in accordance with the Austrian Energy Performance Certificate Act (EAVG 2012) based on the certificate made available to us.
3. Commission
Information about brokerage commission is provided in the individual property listing and in the property documentation. Any commission is subject to the statutory provisions, in particular the Maklergesetz and the Immobilienmaklerverordnung, and to the brokerage agreement concluded in each individual case.
4. Intellectual property
All content on the Website, including texts, photographs, videos, graphics, logos and the design, is protected by copyright and other intellectual property rights and belongs to us or to the respective rights holders. "Christie's International Real Estate" and related marks are the property of their respective owners and are used under licence.
You may view and print content for your personal, non-commercial use. Any other use, in particular reproduction, distribution, modification or public display, requires our prior written consent.
5. Acceptable use
When using the Website, you must not:
- use automated means (such as bots, scrapers or crawlers) to extract property listings or other content, except for search engines indexing the Website;
- interfere with or disrupt the Website, its servers or its security features;
- submit false, misleading or unlawful information through our forms;
- use the Website for any unlawful purpose or in breach of these Terms of Use.
6. External links
The Website may contain links to third-party websites, including social networks. We have no control over their content and are not responsible for it. The operator of the linked website is solely responsible for its content. If we become aware of unlawful content on a linked website, we will remove the link without delay.

11. Governing law and jurisdiction
These Terms of Use are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in the EU, you also retain the protection of the mandatory provisions of the law of your country of residence.
For businesses, the exclusive place of jurisdiction is the competent court in Vienna, Innere Stadt. For consumers, the statutory places of jurisdiction apply.
12. Severability
If any provision of these Terms of Use is or becomes invalid, the remaining provisions remain unaffected.
